    Kiinzel, Inc. ("Kiinzel," "we," or "us") knows that you care how information about you is used and shared. This Privacy Policy explains what information of yours will be collected by Kiinzel when you use the Kiinzel Site, how the information will be used, and how you can control the collection, correction and/or deletion of information. We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources. Capitalized terms that are not defined in this Privacy Policy have the meaning given to them in our Terms of Use Agreement.


    The privacy practices of this statement apply to our services available under the domain and subdomains of http://kiinzel.com (the "Site") and apply generally to our subsidiaries or joint venture websites.


    By registering with the Site you agree to be bound by the terms and conditions of this Privacy Policy. If you are not in agreement with these terms and conditions, please do not register with or use or access the Site. By accepting this Privacy Policy, you expressly consent to our use of your personal information and its disclosure in accordance with this Privacy Policy. By accepting an offer or confirming a trade and/or purchase/sell transaction you will be confirming your acceptance of this Privacy Policy.

  • International Transfer

    YOUR INFORMATION MAY BE TRANSFERRED TO – AND MAINTAINED ON – COMPUTERS LOCATED OUTSIDE YOUR STATE, PROVINCE, COUNTRY OR OTHER GOVERNMENTAL JURISDICTION WHERE THE PRIVACY LAWS MAY NOT BE AS PROTECTIVE AS THOSE IN YOUR JURISDICTION. IF YOU ARE LOCATED OUTSIDE THE UNITED STATES AND CHOOSE TO PROVIDE INFORMATION TO US, KIINZEL TRANSFERS PERSONALLY IDENTIFIABLE INFORMATION TO THE UNITED STATES AND PROCESSES IT THERE. YOUR CONSENT TO THIS PRIVACY POLICY FOLLOWED BY YOUR SUBMISSION OF SUCH INFORMATION REPRESENTS YOUR AGREEMENT TO THAT TRANSFER.
  • Information We Collect

    Kiinzel collects individually-identifiable information from individuals who visit the Site ("visitors") and individuals who register to use the Site ("users"). You can browse through selected portions of the Site without providing any personal information. To register you have to provide us with your name and email address and you are no longer anonymous to us. Thereafter, you are required to provide such personal information as may be necessary to complete a sale or trade transaction and to pay any applicable fees.


    User-Provided Information: You provide us personally identifiable information about yourself, such as your name and e-mail address, if you register for a Kiinzel Account with the Site. You also may give us permission to access your information in other services – for example, you may link your Facebook or Twitter account to Kiinzel, which allows us to obtain information from those accounts (e.g., your friends or contacts). The information we obtain from those services often depends on your settings or their privacy policies, so be sure to check what those are. You may also provide other personal information. This can include your profile photo, comments, personal interests, wish-lists information, and any other information you provide us. You may provide us personally identifiable information in User Content you post to the Site, including without limitation by posting or conducting a sale or trade transaction. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We may also retain any messages you send through the Site. Kiinzel will collect transactional information based on your activities on the sites (such as trading, offering, buying, selling and content you generate or that relates to your account). If you choose to post messages in our message centre, reviews, or other message areas or leave feedback for other users, we will collect that information you provide to us. We retain this information as necessary to help resolve disputes, provide customer support and troubleshoot problems as permitted by law.


    We also collect the other information that you provide as part of registration and the administration and personalization of your Kiinzel Account profile, including without limitation your zip/postal code and individual preferences or demographic information. ("Non-Personally Identifiable Information").


    Non-Personally Identifiable Information may be used in conjunction with other information in a manner that may constitute personally identifiable information (for example, combining your zip/postal code with your street address).


    We may combine your personally identifiable information with Non-Personally Identifiable Information and aggregate it with information collected from other Kiinzel Users to provide you with a better experience, to improve the quality and value of the Site, and to analyze and understand our Site. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you in accordance with your account preferences.


    Cookies Information: When you visit the Site, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser and lets Kiinzel help you log in faster and enhance your navigation through the site. A cookie may also convey information about how you browse the Site to us. A cookie does not collect personal information about you. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser's directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled.


    Log File Information: Log file information is automatically reported by your browser each time you access a web page. When you use the Site, our servers automatically record certain log file information. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, and other such information. Log file information may be used in conjunction with other information in a manner that may constitute personally identifiable information.


    Clear Gifs Information: When you use the Site, we may employ clear gifs (also known as web beacons) which are used to track the online usage patterns of our users anonymously. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make Kiinzel better for our users. Clear gif information is not personally identifiable, however, clear gif information may be used in conjunction with other information in a manner that may constitute personally identifiable information.


    Device Identifiers: Due to Internet communications standards, when you visit or use the Site we automatically receive your computer's Internet Protocol (IP) address (or the proxy server you use to access the World Wide Web), your computer operating system, the type of Web browser you are using, and your Internet Site Provider (ISP). This information is used to analyze overall trends to help us improve the Site. When you access the Site by or through a mobile device, we may access, collect, monitor and/or remotely store one or more "device identifiers." Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device and are used by us to enhance your use of the Site. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent to the device by Kiinzel. A device identifier may convey information about how you browse the Site to us. A device identifier does not collect or share any personally identifiable information about you, however, a device identifier may be used in conjunction with other information in a manner that may constitute personally identifiable information. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Site. Some features of the Site may not function properly if use or availability of device identifiers are impaired or disabled.


    Location Data: When you utilize the Site by or through a mobile device, web application or other means, we may access, collect, monitor and/or remotely store "location data," which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey information about how you browse the Site to us. Location data does not collect or share any personally identifiable information about you, however, location data may be used in conjunction with other information in a manner that may constitute personally identifiable information. Some features of the Site, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.

  • How We Use and Share Your Information

    Our primary purpose in collecting your personal information is to facilitate your use of the Site, render our site more responsive to the needs and desires of its users, and continue to enhance the overall user experience. By providing us with your personal information, you consent to our use of such information in accordance with this Privacy Policy.


    We use the personal information you submit to operate, maintain, and provide to you the enhanced features and functionality of the Site. We use your personal information and other information we obtain from your current and past activities to: resolve disputes; troubleshoot problems; help promote safe marketplace; collect fees owed; measure consumer interest in our products and services, inform you about online offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our Terms of Use Agreement; and as otherwise described to you at the time of collection. At times, we may look across multiple users to identify problems or resolve disputes, and in particular we may examine your personal information to identify users using multiple User IDs or aliases. We may compare and review your personal information for errors, omissions and for accuracy.


    By providing Kiinzel your email address (including by "following," "liking," adding the Kiinzel application, linking your account to the Kiinzel service, etc., on a third party website or network), you consent to our using the email address to send you Site-related notices, including any notices required by law. You also agree that we may send you notifications of activity on the Site to the email address you give us, in accordance with any applicable privacy settings. We may use your email address to send you other messages, changes to features of the Site, or special offers. You may not opt out of Site-related e-mails at anytime.


    Kiinzel may use certain information about you and/or your User Content internally for purposes such as analyzing how the Site is used, diagnosing service or technical problems, maintaining security, and personalizing content.


    Kiinzel may provide blogs, message centers, or comment areas (collectively community discussions). Kiinzel is not responsible for the information you choose to submit via these community discussions. To request removal of your information from community discussions, contact us at support@kiinzel.com. In some cases, we may not be able to remove your information, in which case we will let you know if we are unable to do so and why. We may maintain copies of such information for our records.


    Your User ID is displayed in connection with Kiinzel activities (e.g. offer and listing information) and may be available to the public. This personal information is by its nature public and there can be no expectation of privacy with respect to this information. For example, other people may see the items you are offering to trade or sell and items that you want, items that you have acquired by trading or purchased in the past, your feedback rating and associated comments, your postings, and so on. If you associate your name with your user information (e.g. User ID), the people to whom you have revealed your name will be able to personally identify your Kiinzel activities.


    Kiinzel reserves the right, but has no obligation, to monitor the User Content you post on the Site. We reserve the right to remove any such information or material for any reason or no reason, including without limitation if in our sole opinion such information or material violates, or may violate, any applicable law or our Terms of Use Agreement, or to protect or defend our rights or property or those of any third party. Kiinzel also reserves the right to remove information upon the request of any third party.


    We use cookies, clear gifs, log file information, device identifiers, and location data to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our Site; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems reported by our Users or engineers that are associated with certain IP addresses; (f) help you efficiently access your information after you sign in; and (h) track User Content and Users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act; and (i) automatically update the Kiinzel application on your system and related devices.


    You agree that we may use your personal information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted banner advertisements, product offerings, and communications relevant to your use of the Site. By accepting the Terms of Use Agreement and Privacy Policy, you expressly agree to receive this information.


    If you submit any testimonials, comments, or other messages to Kiinzel (collectively, "Testimonials"), we may ask you for your consent to post your Testimonial on the Site, and to use your Testimonial in our promotional efforts, along with your name and photo. If you want your Testimonial removed, please contact us at support@Kiinzel.com.


    We will retain user information for as long as an account is active or as needed to provide the Services. Without limiting the foregoing, we will retain and use user information as necessary to comply with applicable legal obligations, resolve disputes, and enforce our agreements.


    We may use third party services to facilitate or outsource one or more aspects of the business, product and service operations that we provide to you (e.g., analytics, search technology, discussion boards, payment processors, affiliate and rewards programs etc.) and therefore we may provide some of your personal information directly to these third party service providers. In the event that we provide your personal information, these internal service providers' are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced Site-related operation. In some instances, the third party service provider may collect information directly from you. Their use of such information is governed by their Privacy Policy. In these cases, you will be notified of the involvement of the third party service provider, and all additional information you provide them and their additional uses will be strictly up to you. If you provide additional information to a third party service provider directly, then their use of your personal information is governed by their applicable privacy policy.


    We may share your relevant personally identifiable information with Barterers, Traders, Buyers and Sellers (collectively users of the Site), as necessary to facilitate sale or trade transactions. Kiinzel also enables you to optionally share personal, contact, and financial information to complete transactions. We encourage you to investigate users' reviews and ratings before entering into a transaction or choosing to share your personal information with them. To help protect your privacy, we allow only limited access to other users' information to facilitate your transactions. When users are involved in a transaction, they may have access to each other's name, User ID, email address and other contact information. In all cases, you must comply with data protection and privacy laws and allow other users to review what information you have collected about them.


    Kiinzel may also share your personal and financial information with third party payment processor(s), as necessary to facilitate the creation of listings and sale or trade transactions, or to collect applicable fees. We may store personal information in locations outside the direct control of Kiinzel (for instance, on servers or databases co-located with hosting providers).


    As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.


    Any personal information or content that you voluntarily disclose for posting to the Site, such as User Content, becomes available to the public, as controlled by any applicable service settings. To change your applicable settings on the Site, navigate to your account settings, dashboard and profile pages. If you remove information that you posted to the Site, copies may remain viewable in cached and archived pages of the Site, or if other users have copied or saved that information.


    From time to time, we may run contests, special offers, promotions, or other events or activities ("Events") on the Site together with a third party partner. If you participate in such Events or provide information to such third parties, you give them permission to use it for the purpose of that Event and any other use that you approve. We cannot control third parties' use of your information. If you do not want your information to be collected by or shared with a third party, you can choose not to participate in these Events.


    Except as otherwise described in this Privacy Policy, Kiinzel will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of Kiinzel, our Users or others.


    If you post a Listing, we may publish such Listing (including any associated User Content) via the Site. You may direct the Site to share Listing information with other services (like Facebook or Twitter) when you've chosen to link to your Kiinzel account to those services or publish your activity on Kiinzel to them. For example, you can choose to publish your Listing to Facebook or Twitter. We may also display the geographical location of your Listing in the form of a map so that Kiinzel Users can see the general area and neighborhood of your Listing.


    Non-Personally Identifiable Information: We may share non-personally identifiable information, including information obtained through tools such as cookies, log files, device identifiers, location data and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain Kiinzel Site. Third party vendors, such as Google, may use cookies and log file information, and other data to serve ads on third party sites based on a Kiinzel User's prior visits to and usage of the Site.

  • Your use of other users' information

    In order to facilitate interaction among all Kiinzel community members, the Site allows you limited access other users' contact and shipping information. As a user of the Site you may be provided access to the User ID, email address and other contact and shipping information of the other users involved in the transaction.


    By entering into our Terms of Use Agreement, you agree that, with respect to other users' personal information that you obtain through the Site or through an Kiinzel related communication or Kiinzel facilitated transaction, Kiinzel hereby grants to you a license to use such information only for: (a) Kiinzel related communications that are not unsolicited commercial messages, (b) any other purpose that a user expressly agrees to after you tell them the purpose you would like to use it for. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this Privacy Policy or in the Terms of Use Agreement, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to determine whether to make or accept an offer or confirm a transaction or to communicate with you to complete a transaction in accordance with this Privacy Policy. Note that law enforcement personnel and other rights holders are given different rights with respect to information they access.


  • How We Protect Your Information

    Kiinzel cares about the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Kiinzel or guarantee that your information on the Site may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Your privacy settings may also be affected by changes to the functionality of Kiinzel's distributors, such as social networks. Kiinzel is not responsible for the functionality or security measures of any third party. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the Site. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.


    To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Kiinzel, at all times. You are also responsible for limiting access to devices used to access Kiinzel (e.g. computers, smartphones etc.), and signing out of Kiinzel after a session. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.


    When you enter sensitive information (such as payment credentials), we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, thus, we cannot guarantee its absolute security.   • Accessing, Reviewing and Changing your Personal Information

    You may, of course, decline to submit personally identifiable information through the Site, in which case Kiinzel may not be able to provide certain services to you. You may update or correct your account information (e.g. password), personal preferences, or contact information at any time by logging in to your account and proceeding to your account settings and profile pages. You must promptly update your personal information if it changes, is inaccurate, or you believe may have been compromised. Generally, we will not modify your personal information based on your request because it is very difficult to authenticate your account manually.


  • Children's Privacy

    Protecting the privacy of young children is especially important to us. Children under the age of 18 are not eligible to use our Site without the supervision of a parent or guardian. Kiinzel does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register as Users. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to or on Kiinzel. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.   • Legal Requests

    Kiinzel cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you and the Kiinzel community from bad actors. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorize us to) disclose your personal information and available transactional history in connection with the Site without a subpoena. Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to: prevent imminent physical harm or financial loss; or report suspected illegal activity.


  • Phishing

    Identity theft and the practice currently known as "phishing" are of great concern to Kiinzel. Safeguarding information to help protect you from identity theft is a priority to Kiinzel. We do not and will not, at any time, request your credit card information, your Kiinzel Account login credentials and password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.   • Information Exchanged Between Users of the Site

    Users of the Site are not our employees or consultants and we are not a party to any transaction between you and the seller. As a result, we cannot control their actions and cannot be held liable for any actions that they may take, including but not limited to with respect to your personally identifiable information.


  • Links to Other Web Sites & Third Parties

    We are not responsible for the practices employed by websites linked to or from the Site, nor the information or content contained therein. Please remember that when you use a link to go from the Site to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our website, is subject to that website's own rules and policies.   • Notification Procedures

    It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on the Site, as determined by Kiinzel in its sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.


  • Cancellation of the Site

    Upon your request, we will deactivate your account, contact information, and other applicable personal and profile information. To make this request, email support@kiinzel.com. Such information will be deactivated as soon as reasonably possible based on your account activity and applicable law.


    We will retain in our files some personal information you have requested to remove to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use Agreement and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from public and user viewing and will only be available to select Kiinzel personnel.


  • Changes to Our Privacy Policy

    Kiinzel may update its Privacy Policy from time to time, and so you should review this Policy periodically. When we change the policy in a material way, we will update the 'last modified' date at the top of this Privacy Policy. Changes to this Privacy Policy are effective when they are posted on this page.
